1These terms
These terms are an agreement between you and AGP Software Solutions Inc. ("AGPSoft", "we", "us"), which runs bzzd at bzzd.io
("the service"). By creating an account or sending a message through the service, you agree to them. If you use
bzzd for an organization, you agree for it too, and confirm you may do so.
Our Privacy Policy explains what we do with the information the service handles, and is part of these terms.
2The service
bzzd receives messages from your apps, scripts and services, through its API, webhook URLs and compatible
endpoints, and delivers them as push notifications to the devices you add and to your inbox on the web. It also
watches heartbeat checks: it expects a ping from your jobs on a schedule, and alerts you when one doesn't arrive.
We keep improving bzzd, so features may change, and some may be added, limited or retired. If we remove something you pay for, we'll tell you first.
3Your account
- You must be at least 16 years old, and give a real email address you can read.
- Keep your password, app tokens, user key and ping URLs secret. Anyone who has them can act as you within what they allow. If one leaks, reset it from the Apps or Account page, and tell us if your account was misused.
- You're responsible for what's sent through your apps and checks, including by people or systems you give a token to.
- When you share an app, its members get the messages it sends, and every copy counts towards your plan.
4Acceptable use
Use bzzd for notifications you're entitled to send. You agree not to:
- send spam, advertising or messages to people who didn't agree to receive them;
- send anything unlawful, or anything that infringes someone else's rights, harasses, threatens, or contains malware;
- probe, overload or disrupt the service, or get around its limits, for example with many accounts in place of a plan;
- resell the service or offer it as part of your own, unless we agree in writing;
- access other people's accounts or data, or try to.
We may limit, pause or close an account that breaks these rules or puts the service or others at risk. Where we can, we'll tell you first and give you a chance to fix it.
5Plans and limits
Each plan has limits on messages a month, apps, devices, heartbeat checks and how long history is kept; the
pricing section lists them. The Free plan
(1,000 messages a month) costs nothing and has no time limit. When an account
reaches a limit, the service refuses what's over it, for example messages after the month's allowance, until the
next month or a plan change. Requests are also rate-limited to keep the service fast for everyone.
6Paid plans and payment
- Payments are handled by Stripe. We never see or store your full card number.
- Prices are shown before you pay, and taxes are added where the law requires.
- A subscription renews automatically at the end of each period until you cancel. You can cancel any time in your account; the plan stays active until the end of the period you paid for, then the account moves to Free.
- If you move to a smaller plan, anything over its limits stays but you can't add more, and history beyond the plan's period is removed.
- We may change prices. We'll tell you at least 30 days before a change applies to you, and it starts with your next period.
- Yearly plans: within 14 days of a charge, we refund it in full, for any reason. After that, if you cancel, we refund the unused part of the year.
- Monthly plans aren't refundable, including for part of a month.
- We don't refund charges older than 60 days, unless the law requires it. Refunds go back to the card you paid with and usually show within 5–10 business days.
7Your content
The messages, images, app names and icons you send stay yours. You give us permission to store, process and
transmit them only to provide the service: to deliver them to the recipients you choose, keep them in the inbox
for your plan's history period, and keep the service secure. bzzd automatically hides things that look
like passwords and tokens in incoming messages, but don't rely on it: avoid sending secrets.
8No guarantee of delivery
Notifications travel through browser and operating-system push services (such as Apple's, Google's and Mozilla's),
networks and devices that we don't control. A phone that's off, offline, in a power-saving mode or with
notifications blocked may get a notification late or not at all. We work hard to deliver every message quickly,
but we don't promise that any message or alert will be delivered, or delivered on time.
Don't use bzzd as the only way to learn about situations where a missed or late alert could cause injury, death or serious loss.
9Availability and changes
We aim to keep bzzd running at all times, but it may be unavailable now and then, for maintenance, failures, or reasons beyond our control. There's no service-level agreement unless we sign one with you.
10Ending your account
You may stop using bzzd at any time, and ask us to delete your account by writing to
[email protected]. We may end the service for you under section 4, or
if we stop offering bzzd, in which case we'll give at least 30 days' notice and refund any time you paid
for and couldn't use. When an account ends, its data is deleted as the Privacy Policy describes.
11Disclaimer
Apart from what these terms promise, the service is provided "as is" and "as available", without warranties of any
kind, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement,
to the extent the law allows.
12Limit of liability
To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages,
or for lost profits, data, or business, including from a notification that arrived late or not at all. Our total
liability for any claim about the service is limited to the greater of what you paid us in the 12 months before the
claim, or US$50.
Some places don't allow these limits; where they don't, they apply as far as the law there permits. Nothing here limits liability that can't be limited by law.
13Indemnity
If someone makes a claim against us because of content you sent through the service or your breach of these terms, you agree to cover the reasonable costs of that claim, to the extent the law allows.
14Changes to these terms
We may update these terms. If a change matters, we'll email you or show a notice in the app at least 30 days before it takes effect. If you keep using bzzd after that, the new terms apply; if you don't agree, you can close your account.
15Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules.
Disputes go to the courts there, unless the law where you live gives you the right to bring them where you live.
